Welcome to Artigo. By using our platform, you agree to the following Terms and Conditions. These terms govern all users including individuals, businesses, and brands who access, use, or commission artwork through our platform. If you do not agree, you must not use our services.

1. Definitions: 

• "Platform" refers to Artigo and all services provided through it.

• "Artist" refers to any creator offering commissioned or original artwork via the Platform.

• "Client" refers to any individual, business, brand, or legal entity commissioning or purchasing artwork via the Platform.

• "Artwork" refers to any creative visual work (digital or physical) submitted, displayed, sold, or commissioned through the Platform.

2. Intellectual Property & Copyright: 

• All Artwork remains the intellectual property of the original Artist, unless a separate written agreement for full copyright transfer is signed and approved by both the Artist and the Platform.

• Clients (including businesses and brands) receive a limited license to use the commissioned artwork only for the agreed-upon purpose (e.g., marketing, internal use, packaging, etc.).

• Any commercial use outside the agreed scope (e.g., resale, rebranding, sublicensing, or large-scale distribution) requires a custom licensing agreement and may be subject to additional fees.

• Artworks cannot be submitted to or used in AI training datasets, neural network training, or any machine learning development under any circumstance.

3. Non-Disclosure & Confidentiality:

• All project-related communication, ideas, concepts, reference materials, and discussions between Clients (individuals or businesses) and Artists — whether via email, platform messages, or calls — are considered strictly confidential.

• Neither party shall disclose, publish, or repurpose such information or discussions without written consent from the other party and the Platform.

• If a brand is outsourcing creative work through our platform, they must ensure their team, agency, or affiliates also comply with this confidentiality clause.

• The Platform and the Artist reserve the right to display commissioned artwork as part of their online portfolio or promotional material, only after the final delivery and with the client’s written consent. Confidential commissions will be fully respected.​

4. Prohibited Uses of Artwork: Clients (individuals or businesses) are strictly prohibited from:

• Using any artwork (commissioned or displayed) to train or enhance AI models, including generative or discriminative systems.

• Reselling artwork as templates, stock illustrations, NFTs, or in any AI-assisted generation tool.

• Removing watermarks, artist credits, or signatures unless mutually agreed upon in writing.

• Misrepresenting authorship or claiming exclusive rights without formal licensing.

5. Use by Brands and Businesses:

• Businesses or agencies using commissioned artwork in branding, packaging, campaigns, or merchandise must outline the scope of use clearly in the project brief or contract.

• Any expanded use beyond the initially agreed scope (e.g., international campaigns, sublicensing, franchising, etc.) requires written approval and additional licensing.

• Artists reserve the right to decline commercial usage beyond the original scope, unless otherwise negotiated.

• If a commissioned artwork is used by any third party (agency, marketing firm, manufacturer, AI company, etc.) on behalf of the Client, the Client shall be fully responsible for ensuring that these third parties comply with all clauses outlined in these Terms and Conditions.

6. Platform Integrity & Artist Protection:

• Artigo acts as a facilitator and promoter of original, ethical art. We reserve the right to suspend or ban any user (individual or business) who violates these terms.

• Harassment, plagiarism, misrepresentation, or exploitation of artists or their work will lead to immediate action, including potential legal recourse.

• The Platform may use watermarking, metadata tagging, and other digital tracking mechanisms to identify unauthorized use of artwork across the internet. The Platform reserves the right to issue takedown notices and initiate copyright claims on behalf of Artists.

7. Refunds and Revisions:

• Refunds and revision policies vary by artist and commission. Clients are expected to review and agree to the specific artist’s policy prior to confirming an order.

• The Platform is not responsible for personal agreements made outside of the Platform’s communication and payment systems.

• In disputes, our moderation team may assist but does not guarantee arbitration results unless it involves a breach of these terms.

8. Limitation of Liability:

• The Platform shall not be liable for any loss, damage, or legal claim arising out of misuse of artwork, breach of copyright by a client, or disputes outside the scope of the commission agreement.

• Businesses are solely responsible for ensuring their usage of artwork complies with advertising, trademark, or regulatory laws applicable in their regions.

• The Platform prohibits the commissioning or sale of artwork that promotes hate speech, violence, discrimination, plagiarism, or any form of unethical or illegal conduct. The Platform reserves the right to reject, remove, or report such content and users.​

9. Governing Law:

• These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.

10. Amendments:

• We reserve the right to update or revise these Terms and Conditions at any time. Continued use of the Platform after changes implies acceptance.
